1. Acceptance and Eligibility

By creating an account you confirm that you meet these eligibility requirements and agree to be bound by these Terms and our Privacy Policy.

2. Skill Gaming and E-Sports Declaration

XIVERARENA is an E-Sports tournament management platform. The tournaments hosted (e.g., Mobile Legends: Bang Bang) are “Games of Skill” where success depends on the player’s training, experience, and adroitness — not chance. For users in India, this classification fulfills the legal tests laid down by the Supreme Court of India (K.R. Lakshmanan v. State of Tamil Nadu). We do not offer, promote, or facilitate gambling, betting, or regulated “Online Money Games” as defined by applicable law in your jurisdiction.

3. X Credits and Xiver Store

The Platform utilizes a closed-loop digital utility token called X Credits.

• Nature of Token: X Credits may be earned through gameplay or purchased via our payment gateway (Cashfree). X Credits are strictly for in-app utility (purchasing digital goods like MLBB diamonds or skins on store.xiver.in).
• No Cash Value: X Credits are non-transferable, non-refundable, and cannot be withdrawn, redeemed, or cashed out for Indian Rupees (INR) or any other fiat currency.
• Pricing and Taxes: Prices for X Credits and digital goods are displayed and charged in Indian Rupees (INR) via our payment gateway (Cashfree). Operating below the statutory GST threshold, XIVERARENA does not currently collect GST in India; where taxes or VAT are required in your jurisdiction, they are added at checkout where applicable, and you are otherwise responsible for any taxes due on your purchases. Receipts for your purchases will be generated and emailed to you. Purchases are also subject to our Refund & Cancellation Policy.

4. Tournaments and Prize Pools

• Any real-money prize pools offered are independently funded and distributed by third-party sponsors outside of the XIVERARENA financial ecosystem.
• XIVERARENA processes no withdrawals and holds no liability for the fulfillment of sponsor pledges.
• Rewards delivered through the Platform itself are granted as digital goods or X Credits only — never as cash.

5. User Conduct and Intermediary Guidelines

XIVERARENA operates as an “Intermediary” under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (India) and applies comparable notice-and-takedown standards worldwide. You agree not to host, upload, or share any display name, team name, or content that:

• Is defamatory, obscene, or invades another’s privacy;
• Violates any intellectual property rights;
• Promotes illegal activity or violates the law of your jurisdiction;
• Threatens the unity, integrity, defense, security, or sovereignty of India.

We reserve the right to terminate accounts and take down unlawful content within 36 hours of receiving a valid court or government order, or promptly where we reasonably believe content is unlawful. Cheating, unauthorized third-party software, match-fixing, smurfing, and toxic behavior are prohibited and may result in disqualification and permanent suspension.

6. Intellectual Property and Third-Party Disclaimer

• XIVERARENA IP: The platform, backend architecture, and branding are the intellectual property of XIVERARENA.
• Third-Party Disclaimer: XIVERARENA is an independent esports community platform. We are not affiliated, authorized, or endorsed by Moonton, Nuverse, or any other game publisher. All game titles, images, and logos are the intellectual property of their respective owners.

7. Limitation of Liability

To the maximum extent permitted by applicable law, XIVERARENA shall not be liable for any indirect, incidental, or consequential damages, including account bans issued by third-party game publishers resulting from your use of our Platform. You agree to indemnify and hold XIVERARENA harmless from claims arising out of your breach of these Terms. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including consumer law.

8. Dispute Resolution and Governing Law

These Terms are governed by the laws of India, without prejudice to the mandatory consumer-protection laws of your country of residence.

• Consumers (all jurisdictions): If you are a consumer, you may bring proceedings in the courts of your country of habitual residence. Nothing in these Terms limits your non-waivable consumer rights, including EU/UK consumer law or, for users in India, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
• India — Consumer Grievances: Under the Consumer Protection (E-Commerce) Rules, 2020, you may escalate service-related disputes to the competent Consumer Disputes Redressal Commission.
• Non-consumer disputes: For disputes not covered above, the courts of Pathankot, Punjab shall have exclusive jurisdiction.

9. Changes to Terms and Contact

XIVERARENA reserves the right to modify these Terms at any time. Changes will be communicated via the platform or email. Continued use of the platform after changes are published constitutes your acceptance of the revised Terms.
